Phoenix City Mayor, City Manager, and Chief of Police served with Federal Lawsuit alleging Civil Rights Violation and Malicious Prosecution Claim
Phoenix Mayor Phil Gordon, City Manager Frank Fairbanks and Chief of Police Jack Harris named in Federal Lawsuit. Then in retaliation, Phoenix police officers raid the home of the plaintiff and take evidence, violating his constitutional rights.
Phoenix, AZ (March 23, 2009) - Mayor Phil Gordon, Phoenix chief of police Jack Harris and Phoenix city manager Frank Fairbanks were named as defendants in a claim filed in Federal Court, on a Section 1983 claim and Malicious Prosecution. The case was filed in District Court for the District of Arizona under the caption, Jeffrey Pataky v. City of Phoenix, et. al, CV 09-534-PHX-DKD
The claim alleges while given the opportunity, Mayor Phil Gordon, city manager Frank Fairbanks and chief of police Jack Harris failed to investigate numerous requests made on the Phoenix Police. The suit claims that the defendants conduct deviated from the duty and care required of police officers and city officials. By purposefully allowing their subordinates to submit fraudulent documents to the county attorney and in some instances, testifying regarding those documents before a Grand Jury, Defendants deviated from their duty and standard of care established by the United States and Arizona Constitution and the Arizona Rules of Criminal Procedure. “This rises to level of extreme and outrageous,” the lawsuit claims, “and was entered into with an evil mind.”
In a retaliatory measure and while the Notice of Claim was still pending, the Phoenix Police raided the Plaintiffs home with a search warrant, unlawfully imprisoned a guest and refused them access to counsel. During the search, officers seized all documents pertaining to the District Court lawsuit, including privileged communications with counsel and all recordings and evidence relating to the District Court case. Seizure of these documents and communications are in violation of plaintiff’s constitutional rights.
A new, second Notice of Claim was filed on March 18, 2009 against Phoenix Mayor Phil Gordon, City Manager Frank Fairbanks and Chief of Police Jack Harris, and these additional claims will be included as new counts in the original suit. The raid of plaintiff’s home was nothing more than intentional harassment and retaliation for speaking out against public officials and their subordinates on a website named badphoenixcops.com; and is nothing more than exercising one’s First Amendment Rights to free speech.

this is my first time to comment. I applaud you for pointing out the corruption and downright vileness in the upper Ranks of the Phx PD. Good for you for exposing these scumbags. I hope you will receive the support you need to expose the cover up and down right criminal behavior of the Homicide Detectives in the Mark Goudeau case
They should be charged after their criminal cover up is exposed and then they would wind up where I retired from after a successful 20 yr career as a Lt. DOC had its problems and scandals but this is playing in the big league compared to the Stuff our Warden's, Directors and Central Office Staff were involved in.
I will try and check back dly to keep up and sure hope since I haven't seen a Post that your side isn't down.

This is such poor good will when a resident's home is raided and Police abuse their power. I have studied law for 20 years and this is so eggregious.
There is nothing worse then a dirty cop. There's just something that strikes a nerve with people when then see corruption and power abuse among police.
All Peace Officers need to worry about this. As the public finds this out more and more, all POs will lose credibility and will put themselves in harms way and subject themselves to violent disobedience.
They will be viewed with distaste much like the AIG guys who took those bonuses.
I really don't think Jack Harris, the Phoenix PD or SID thought this through strategically or ran it by Legal. They should have thought about this much like a game of chess.
BadPhoenixCops just trumped you guys and called Check Mate! There is a clear violation of both the First Amendment and the Fourth Amendment and this will cost our city millions of dollars to undo.
Now what are you going to do Jack...Kill this guy? Make him go away? Arrest him? No matter what you do, (other than paying him off)will be very, very bad.
The barn door is wide open with his lawsuit and press release, and the horse ain't coming back. I know his attorney Jess quite well, and you guys are in for a world of hurt and publicity. Jess has represented cops and knows how to tear you apart. All he needs is a good Judge.
great news for the honest police officers of the PPD. But you have to ask yourselves this... What does all this really mean in the long run? You know damn well that in the end, the fucksticks up on the fourth floor along with that scumbag mayor will wlk off into the sunset with money still falling outta their pockets. I hate those fucks too, but the people that come in and replace them prob wont be any better. It just seems like a waste of time to focus on say, 10 persent of the overall problems of the PPD. I can write a list of shit that pisses me off about the PPD and the stunts that these scumbags dont even make the top ten. I work outta 500, and belive me I work with some real peices of shit... but there are outnumbered by some real good people. usually, the bad fucks are weeded out pretty quick.
anyways... its good to see that YOU might see the day that YOUR problems are solved. But as for me, a regular "beat cop" I dont lose sleep at night thinking about the problems up at 620. that shit doesnt effect me in the least.
I will say this though, heather does give a decent BJ.
But here is what you need to know, our brother from 500. Will you be a beat cop forever? Eventually you will want to be a sergeant or a liuetenant and begin a path of leadership (everyone does). What happens if you are involved in an incident that has you investigated. Don't you want fair impartial treatment?

to have leaders you admire and respect? If we can get 10 of you to take 10 more under their wings, then this is a start. I tell every 10+ year veteran to tutor and mentor the new guys in "the ways of the force" and "not the darkside."
Our best supports are Sgts and Lts who have been there for 10-15-20-25years and have seen the bullshit with the current Jack Ass and Hurtt and all these asst. chiefs who have risen to their levels of ineptitude. Blake McClellan didn't get a job as the Tucson Chief - wanna know why? He couldn't lead or inspire a starving dog to follow him if he had food in his hand.
The problems posted here are systemic. This site has never been above solving "my" problems or any one indivuals problem.
This site has been about eradicating a disease that is killing this city named Jack Harris and every one of his croonies who do his dirty bidding.

point well taken. but... this site is focused on a dozen or so cops that most likely wont be here in the next few years regardless if its by their own choice or not. so why not just let nature take its course? my point is this. if there was as much attention and focus on solving the problems that a "beat cop" like myself face everyday, im talking about the challenges that we face on a daily or even hourly basis we would make a great job even greater. anyways. i still applaud you and will quietly support your fight. look whos slated to take the reigns next... that doesnt seem to be much of an improvement.
again, i understand the importance this has on the PPD as a whole. i just have a hard time being an active or "vocal" supporter.
